My wife said that she divorced me 3 years after we get married in Moscow. This is because I could not bring her to the U.S. Also, she did not send me any paperwork or documents about the divorce. How do I verify that she indeed divorced me and how do I get the divorce certificate without going back to Moscow. Thank you for your time.

Answer:

You should receive now court decision and Divorce Certificate in Zags office and have it apostilled. I can do all of these for you. To do it, you should send to my address: Power of Attorney with apostille in order to I act in Court and Zags on your behalf (I will send you the text); notary certified copy of your passport with apostille and pay my fee. I can start work immediately after receiving of your payment. Please advise me about your decision.

Answer:

You can dissolve your marriage under the laws of the United States by going to the American embassy in Moscow. You may also accomplish your goal under the laws of the Russian Federation provided that either of you have lived in Russia legally for long time. Under what status you and your wife live in Russia? Do you have adolescent children? Have you and your wife already reached an agreement on the dissolution of the marriage? In case you and your wife have legal grounds to terminate the marriage under the laws of the Russian Federation, I am ready to represent you.

Question:

My boyfriend is an American citizen (formerly Russian citizen) and wants to file for divorce to someone who is still a Russian citizen, living in Russia. This person stated they will contest the divorce even though they have never lived together, nor seen each other in 4 years. Is there such a thing as annulment of marriage in Russia (since they have never lived together)? If he files for divorce and she contests the divorce, how long can the process take? I'm sure he is going to have to hire a lawyer to represent him, so any advice will be appreciated. Thanks! Also, can you be reached by phone on the weekends if he decides to retain a lawyer from your firm?

Answer:

In Russian legislation there is no such term as "annulment of marriage". There are terms "break marriage" and "acknowledge marriage void". The acknowledgement of marriage as void implies that marriage was registered either with breach of the law (such cases are described in the law) or without goal to create family, i.e. pro forma marriage (such case are very difficult to prove and I consider this hopeless). So, in your case the only possible way is to break marriage (divorce), not annulment. The divorce case is scheduled at Russian court in one month from the date of applying. If his wife would contest divorce, the court has a right to allow them a time for conciliation for three month. There are also other ways to delay the case. But usually a divorce case with preparing of all the necessary documents takes from 2 to 6 month. \nIt is very important to know the exact address of residence of his wife in Russia. And it's advisably to hire a lawyer for the divorce because it's very difficult and long term to prepare all the necessary documents and get the divorce oneself, especially if he doesn't live in Russian and considering position of his wife. \nOf course your boyfriend can call me at +7-921-946-0582 and I can speak with him in Russian language.

In order to start divorce proceedings in Russia you need: \n- notary certified Power of Attorney (I will send you the template) that allow me to act on your behalf; \n- have this Power of Attorney apostilled at secretary of your state (it's needed to legalized the document abroad), I can also send you an example of the apostille; \n- send me by express mail (UPS, TNT, DHL, FedEx etc) the Power of Attorney, original of your Marriage Certificate and photocopy of your passport. \nAll other actions are being provided by me. \nPlease tell me the following data: \n1. I married a Russian lady, and after 6 years of marriage, we are divorcing. I found her diary which details her plan to divorce me after she got her passport, and her plan to bring her Russian boyfriend over to marry him. I would like some information on how common this is, information on how Russian law divides assets, and Russian law on bad faith.

It is a philosophical question about "how common this is" and I cannot make legal estimation this way: all people are different, for someone marriage is needed for citizenship and material comforts, someone has other meaning about family and marriage. \nAbout legal side of this issue: your marriage can be dissolved both is the USA and in Russia. In case you will decide to divorce in Russia, I can participate in this proceedings in court and in ZAGS (full cycle until you receive you divorce certificate). \nBecause your common place of residence is the USA, assets should be divided under law of your country. If your wife keeps Russian citizenship - in this case it's possible to divorce in Russia. \nRefusing your wife to give you marriage certificate doesn't cause problems: it's possible to get a duplicate. \nYour visit to Russia is not required. You can draw up Power of Attorney and a jurist can act in Russia on your behalf. I explain you more about this Power of Attorney if you would be interested. \n Such proceedings can take from 2 to 6 month. If your wife agree to divorce and signs such agreement - it would take less time. \nPlease answer my following questions: \n1. How does you wife fill about the divorce? Does she agree? \n2. Does you wife keep/have a place of registration in Rostov-on-Don? \n3. Does you wife have Russian citizenship? \n4. Do you have common children? \n5. Do you know her address in Rostov-on-Don? \n6. Do you have any copy of your marriage certificate? \nIt is difficult to me to specify exactly a fee in this case because I don't know yet the amount of work and possible expenses incurred. I have a client who has been divorced in England, has returned to Russia to live and now wishes to remarry there. I understand that an apostille is required. I shall be grateful if you would please confirm if this is correct and if so whether it is just the decree absolute document (which finally dissolves the marriage in the UK) which needs an apostille or if there are any other documents necessary to enable my client to remarry in Russia. Answer:

Yes, because the UK signed the Hague Convention from October 05, 1961, the document (divorce certificate) confirming that the marriage of your client was dissolved, needs apostille. \n In Russia this final document with apostille shall be translated into Russian and correction of this translation shall be notary certified. Then this document becomes legal in Russia. \nI suppose that in addition to the divorce certificate, for new marriage your client has to have a reference document about he/she is not married at the moment. And also a notary translation of his/her passport into Russian is required in case he/she is not a Russian citizen.

If I obtain a divorce from my Russian wife in the United States and she is now back in Moscow with a permanent 10 year USA green card, then should my US divorce be filed or should it follow any US Russian or International Treaty? or can I just follow US law? \nIf there is a treaty what is the name of it and where can I find information about it?

Answer:

Divorce cases completed in the US are valid in Russia, as well as divorce cases completed in Russia are valid in the US. If your wife is registered at the place of her current living in Russia, then I believe it makes sense to file for the divorce in Russia. If, however, she is not registered in Russia, then it will be faster and better to file for divorce in the US. \nI believe that in that case, the document announcing the completion of the divorce needs to be legalized, i.e. apostilled. Then, the document needs to be translated to Russian and the translation be notarized. All this is required according to the Hague convention from October 5, 1961, which is signed by both Russia and the US. \nSince I am a Russian lawyer, I deal with divorces cases filed in Russian courts, and can assist you in that matter. Unfortunately, I only have a text of Hague convention in Russian, and not in English. \nI hope, I answered all your questions.

It is sad that your story has not ended yet. \n Ludmila and her lawyer can think whatever they like, but you possess a document, which was not objected by anybody and which has been completed in accordance with international law (Hague Convention from October 5th, 1961). This document is your Divorce Certificate. \nI think that on August 12th you need to go to the court with your lawyer. I know Russian and international law. It is my understanding that your problem relates to Ludmila having to move out from your house. It is obvious that that case will be heard based on the internal laws of the US and the state of Massachusetts. \nI would be happy to help you in solving the problems related to the use of Russian and international laws. \nI am shocked with Ludmila behavior, her behavior is unforgiving. I sincerely wish you to finish that conflict happily. My wife and I lived together only on the island in the Azores which is part of Portugal from Mid-October, 2001 until the first week of January 2, 2002 (about 2 months). I moved back to Azores in October last year to live with her. While in Lisbon to get papers for her Residency Visa our bags were stolen with all her documents. \nMy wife returned to Russia early January to get a new Passport and she insisted on not coming back to live on the Azores where I was planning to live. I am a Citizen of Portugal with a Green card to USA. \nI am back in USA because my wife did not want to live with me where I was planning on raising a family. \nShe thought she was coming directly to the USA and I did not want to have children in USA but in Azores where my family is. \nI am not worried about my situation in USA which is why I did not mention it before for these reasons: \n 1- she never lived or visited me in USA\n2- our only time together was in Astrakhan and Moscow 1 week and on Azores 2 months\n3- I put her name on my bank account in Pico which is why I was concerned about the shared account. \nFrom my wife's last email to me which I forwarded to you it is her idea to get a divorce since she does not wish to live on the island and was not happy with the $300.00 US per month I was sending to her in Russia. \nI have not heard anything from her sense that email. \nShe has lied to me frequently and I do not trust her. \nI have since stopped sending her any money and I will want a divorce as soon as possible. \nSince this is her idea, there should not be a contesting from her side. \nI have all her emails saved and can send if needed. \nMy Wife was supposed to ask for a new marriage certificate in February in Astrakhan and I sent her money for this. I have understood your situation. Please send me the copy of your Marriage Certificate. Also please send me your data in order to fill out the Power of Attorney. For this I am needed the following: your full name, the address of your residence, full name of your wife and her address of residence (but these you have sent me already). \nAfter that I will send you a template of Power of Attorney that you should sign, notarized and have Apostille. I married on Nov. 2001 at a town Saratov. After a day of marriage I returned to USA. When I got to USA she asked for divorce stating that she got back to her boyfriend. I signed paper that she sent me for divorce and mailed to her on February 2002. I have original marriage certificate and she has copy of it. She married to me on the paper but sleeping with her old boyfriends. I pray God that it never happens to any man in the world. I lost the money for the 2 trips that I make to marry her. If your wife will not contest the divorce, I can participate in this proceeding. Answer:

If their marriage certificate is legalized for Russia (i.e. has apostille and notary translation into Russian), the marriage can be broken in Moscow. \nThey are able to divorce either in Russian court or in ZAGS in district there wife of your son has registration. For ZAGS they have to bring joint application for divorce. I can provide your son with detailed consultation about steps that are required for divorce or I can participate in proceedings in court or ZAGS until he will get divorce certificate.
